Privacy Statement of Tronix Lighting B.V.
This privacy statement specifies how Tronix Lighting B.V. (hereinafter: Tronix Lighting), with its registered office at Vluchtoord 41, 5406 XP Uden, processes your personal data when using the website (hereinafter: "the Website") and offering products.
Protection of personal data
Tronix Lighting considers it's important that the security and privacy of your personal data are guaranteed. When doing our business we therefore comply with the applicable laws and regulations relating to data protection and data security. We hope that the policy described below helps you to understand which personal data Tronix Lighting can collect, how Tronix Lighting uses and protects these personal data and with whom we might share these personal data.
Personal data
Tronix Lighting will not collect any personal data of yours via its websites, such as your name, address, telephone number or e-mail address, unless you voluntarily chose to provide these data (for example in order to register for our newsletter, fill in contact forms, via a survey or by generating an account), you give permission to collect such data, or the collection of such data is otherwise allowed under the applicable laws and regulations relating to the protection of personal data.
Tronix Lighting processes the following personal data:
- Name;
- Company name;
- E-mail and street address;
- Telephone number;
- Data pertaining to the device used by the data subject, such as an IP or MAC address;
- Information obtained from cookies;
- Bank account number;
VAT number (if established abroad) Tronix Lighting collects and/or processes personal data:
- When the data subject has provided personal data to Tronix Lighting via the Website;
- Because the data subject has contacted Tronix Lighting;
- When the data subject places an order with Tronix Lighting;
- Because these data are generated on the basis of the use of products, services and/or Websites of Tronix Lighting, for example via cookies;
- When the customer provides data via social media, such as a direct message
Purpose of use
When you provide us with personal data, we usually use them to answer questions, process your order or grant you acces to specific information or offers. For the purpose of our customer relationship with you, we can also:
- Save and process personal data and share these data with our affiliated companies to gain more insight into your needs and to understand better how we can improve our products and services; or
- Use personal data ourselves (or allow a third party to do so on our behalf) to contact you about and offer from Tronix Lighting that provides for your needs.
If you do not want your personal data to be used for the purpose of our customer relationship with you (in particular for direct marketing or market research), we respect your decision. We do not sell your personal data to a third party, nor do we make it available to third parties in a different way, except to companies that are affiliated with Tronix Lighting.
Purposes and bases for the processing of personal data
Tronix Lighting processes personal data of one or more processing bases under the General Data Protection Regulation:
- Permission;
- Performance of a contract to which the data subject is a party;
- Legitimate interest of Tronix Lighting
Purpose limitation
Tronix Lighting will only collect, use or disclose personal data that you provide for the purposes made know to you, unless such disclosure:
- Concerns the use of personal data for an additional purpose that is directly connected with the original purpose for which the personal data were collected;
- Is necessary in order to draw up, conclude or perform a contract with you;
- Is required by law or by competent authorities or judicial authorities;
- Is necessary to determine or protect a legal claim or legal defence;
- Is necessary to prevent fraud or other illegal activities, such as intentional attacks on the information technology systems of Tronix Lighting.
Communication or use of data
When you use telecommunication services to gain access to our website, communication data (for example your IP address) or user data (for example about the start, end and duration of each access and information about the telecommunication services to which you have gained access) are generated that might be related to personal data. Your communication or user data will only be collected, processed and used in so far as an imperative need to do so exists, and always in accordance with the applicable laws relating to data protection.
Manner of collecting personal data
Login account
Registration is required to use the webshop. In that case you have to state information about yourself and you have to choose a password. Tronix Lighting uses this to create an account, which you can log into with your username and self-chosen password. For this we use your name and address details, telephone number, address and invoice address, e-mail address, payment details, gender, date of birth, nickname, profile photo and IP address.
Tronix Lighting has a legitimate interest in doing so. Tronix Lighting stores this information up to six months from the time you cancel the account. We store this information so that you do not constantly have to fill it in again and so that we can approach you more easily if that is necessary in the webshop. You can adjust your information via your account whenever you want to.
Handling of orders
When you place an order with us, we use your personal data to be able to handle it. Then we may give your personal data to our delivery service so that they can have it delivered to you. We also receive information about your payment for your bank or credit card company. For this purpose, we use your name and address details, telephone number, e-mail address, payment details, gender, date of birth, nickname, profile photo and IP address.
Tronix Lighting has a legitimate interest in doing so. Tronix Lighting stores this information up to two years after your order has been completed. We store certain customer data longer in connection with the statutory retention period for tax purposes.
Provision to third parties
We work together with certain companies that can receive your above-mentioned personal data from us.
For the handling of orders we work togehter with:
- Our payment provider Rabobank;
- Our post company TNT, FedEx, GLS, PostNL, Select Courier
Access to the portal
With our portal you gain access to a control environment in which you can set, state and change things for the webshop yourself. We keep track of what you have done and when, so that there will be proof of this.
For this purpose we use your name and address details, telephone number, invoice address, e-mail address, payment details, gender, date of birth, nickname, profile photo and IP address. We have a legitimate interest in doing so. We retain this information up to six months after the end of the service(s) provided to you.
Statistics and profiling
We keep statistics on the use of our webshop. We use these statistics to improve our webshop only, for example to display relevant information. We can combine your personal data in order to learn more about you. We do of course respect your privacy at all times. If you do not want us to do this, you can always notify us to that effect.
For this purpose we use your name and address details, telephone number, invoice address, e-mail address, payment details, gender, date of birth, nickname, profile photo and IP address. We have a legitimate interest in doing so. We retain this information for one year.
Location data
It is sometimes necessary for our webshop www.tronixlighting.com to find out where you are located. Then we ask seperately if we are allowed to know this and we obtain this information only if you then give permission to do so. For this service we use the navigation and location software on your telephone, tablet or computer. We have no control over what the manufacturers of this software (such as Google or Apple) do with it. So always read their privacy statements as well.
Advertising
We would like to send you information about offers and new products or services. We do so:
- By post;
- By e-mail;
- Via social media;
- By Telephone
You can object to this advertising at any time. Each letter explains how you must do so. Each e-mail contains an unsubscribe link. You can block us or use the unsubscribe option. You can state this if you are called. You can also indicate this via your account. You can indicate this via the portal as well.
Contact form
You can use the contact form to ask us questions or submit inquiries. For this purpose we use your name and address details, telephone number, invoice address, e-mail address, payment details gender, date of birth, nickname, profile photo and IP address. We have a legitimate interest in doing so. We retain this information until we know for sure that you are satisfied with our response and for six months afterwards. In this way, in case of follow-up questions, we will easily be able to get hold of the information. We will also be able to train our customer service to provide better service.
Statistics
We keep statistics on the use of our webshop. Our webshop includes social media buttons. The managers of these services use them to collect your personal data. We therefore advise you also to read the privacy statements of the social media services.
Provision to other companies or institutions
With the exception of the above-mentioned partners, we will not under any circumstances give your personal data to other companies or institutions, except if we are legally required to do so (for example if the police demand it in case of suspicion of a crime).
Automatically collected non-personal data
When you visit our website, we can automatically (i.e. without registration) collect non-personal data (such as the type of internet browser or operating system used, the domain name or the website where you come from, the number of visits, the average duration of a visit, the pages viewed). We may possibly use these data to measure the attractiveness of our website and to improve the performance or contents of the website.
"Cookies" (information that is automatically stored on your device (smartphone, tablet or computer)).
When you visit our website, we may save data on your computer in the form of a so-called "cookie", so that your device will automatically be recognised during a following visit. Cookies help us in many aspects. For example: The enable us to attune the website better to your interests or to store your password, so that you will not have to enter it again each time you log in.
If you do not want to receive cookies, you must set your internet browser in such a way that all cookies are deleted from your hard disc, that all cookies are blocked or that a warning is given before a cookie is saved. These can also be personal data. Tronix Lighting can combine the automatically collected data with data about your device (e.g. an IP address). Security
Tronix Lighting uses technical and organisational security measures to prevent your personal data from being destroyed, lost or changed by accident or unlawfully and to protect them against unauthorised publication or access.
Rights of the data subject
If Tronix Lighting processes your personal data, you as a data subject have several rights:
- Right of access: You have a right to access and obtain a copy of the personal data that Tronix Lighting processes.
- Right to rectification: You have the right to rectify and/or supplement the personal data relating to you if these data are incorrect and incomplete.
- Right to limitation of processing: You have the right to request Tronix Lighting to (temporarily) limit the processing of your personal data if one of the following situations occurs:
- You dispute the correctness of the personal data relating to you. The processing will be limited during the period that Tronix Lighting needs to check the correctness of your personal data;
- The processing of your personal data is unlawful, and you object to the erasure of your personal data, and request instead to have the processing of the personal data limited;
- Tronix Lighting no longer need the personal data for processing purposes, but you need them to bring, conduct and substantiate a legal claim;
- You have objected to the processing and you are waiting for an answer to the question whether the legitimate grounds of Tronix Lighting outweigh your own grounds. - Right to portability: You have the right to obtain your personal data that are processed by Tronix Lighting in a structured and customary (digital) format, in order to transfer them undisturbed to another controller.
- Right to object: You have the right to object to the processing of your personal data if the processing takes place on one of the following grounds for processing: 'performance of a task carried out in the public interest' and/or 'representation of legitimate interests of Tronix Lighting'. Tronix Lighting will discontinue the processing of personal data if it is unable to put forward legitimate grounds for the processing that outweigh the interests, rights and freedoms of the data subject.
- Right to erasure of personal data: You are entitled to request Tronix Lighting to delete your personal data. Tronix Lighting will grant this request if one of the following situations occurs:
- Your personal data are no longer necessary for the purposes for which they were collected or were otherwise processed;
- You have withdrawn your permission for the processing of your personal data and there is no other legal ground for the processing;
- You have submitted a well-founded objection to the processing of your personal data;
- Your personal data were processed unlawfully.
If you have given permission to process the personal data, then you will be entitled at all times to withdraw such permission. All processing activities that took place prior to withdrawal will be considered to have been carried out lawfully.
Retention period
Tronix Lighting retains the personal data during the period it needs to achieve the purpose for which the personal data were initially collected, unless Tronix Lighting is required to retain the personal data longer under a statutory provision.
Amendments to this privacy statement
Tronix Lighting reserves the right to amend this privacy statement. Each amendment will be announced on this page. Tronix Lighting therefore advises the data subject to look at this page regularly for possible amendments to this privacy statement.
Complaints
You have the right to submit a complaint about the way in which we deal with your data. If you have a complaint, you can contact us. You also have a right to address your complaint to the Dutch Personal Data Authority (Authoriteit Persoonsgegevens):
